Short version: this is a free "coming soon" page with a mailing list. Use it in good faith, don't attack it, and understand that anything we recommend about Southern California is general information — not professional advice, and not a promise about anyone else's business.
These terms are an agreement between you and Hungry Passport Media, Inc., 4225 Solano Ave., Suite 631, Napa, CA 94558, USA ("we", "us"), covering thisissocal.com and anything we publish on it. By using the site or joining the mailing list, you accept these terms. If you do not accept them, please do not use the site.
1. What the site is
Right now thisissocal.com is a pre-launch page: a description of what we are building and a form to join the launch list. It is provided free of charge. There is nothing to buy, no account to create, and no paid service on this site today. When we launch the full site, these terms will be updated to cover whatever it offers.
2. Who may use it
You must be at least 13 years old to submit an email address. If you are under the age of majority where you live, use the site only with a parent or guardian's involvement.
3. The mailing list
Submitting the form asks us to email you about the launch and about the SoCal Weekend Guide. Please submit only an address you control. You can unsubscribe at any time, and we may retire the list, stop sending, or change what we send at any point before launch. We do not guarantee any particular launch date — or that we will launch at all. How we handle your address is described in our Privacy Policy.
4. Acceptable use
You agree not to:
- submit someone else's email address, or a false or misleading one;
- submit automated, bulk, or spam entries, or attempt to defeat the form's anti-spam protection;
- attempt to gain unauthorized access to the site, its host, or any connected system;
- probe, scan, overload, or disrupt the site, or use it to distribute malware;
- scrape, harvest, or mine the site or its email addresses; or
- use the site in violation of any applicable law.
We may block access or remove anyone from the mailing list for any of the above.
5. Our content
The name "This is SoCal", the logo, the design of this page, and its text and artwork are owned by us or our licensors and are protected by intellectual-property law. You may view and share links to the page. You may not copy, republish, or adapt the logo, artwork, or substantial parts of the content for your own commercial use without our written permission. If you send us feedback or suggestions, we may use them freely without owing you anything.
6. Information, not professional advice
Everything we publish about Southern California — places, food, hikes, events, day trips — is general information for personal, recreational use. It is not professional, safety, medical, legal, or financial advice. Conditions change: businesses close, trails wash out, tides and surf turn dangerous, roads shut, prices and hours move, and access rules differ by season and by agency. Verify current conditions with the operator or the responsible authority before you go, and use your own judgment about your fitness, equipment, and safety. You are responsible for your own decisions and for following the rules of any place you visit.
7. Third-party links and services
The site links to Instagram and relies on a third-party form provider. We do not control those services, we are not responsible for their content, availability, or practices, and a link is not an endorsement. Your use of them is governed by their own terms.
8. Availability
We provide the site "as is" and "as available". We may change, suspend, or discontinue it, in whole or in part, at any time and without notice. We do not promise it will be uninterrupted, error-free, or free of harmful components.
9. Disclaimer of warranties
To the fullest extent permitted by law, we disclaim all warranties, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, and accuracy or completeness of content. Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you.
10. Limitation of liability
To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, or loss of goodwill, arising out of or relating to your use of the site or reliance on its content — including any injury, loss, or expense arising from a trip, activity, or place mentioned on the site. Our total liability for any claim relating to the site will not exceed one hundred US dollars (US$100). Nothing here limits liability that cannot be limited by law, including for fraud, or for death or personal injury caused by our negligence.
11. Indemnity
You agree to indemnify and hold us harmless from any claim, loss, or expense (including reasonable legal fees) arising from your misuse of the site or your breach of these terms.
12. Changes to these terms
We may update these terms. The updated version will be posted on this page with a revised "Last updated" date, and changes apply prospectively from the date they are posted. Continuing to use the site after that means you accept them.
13. Governing law and venue
These terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Unless applicable law requires otherwise, any legal action relating to these terms or the site must be brought in the state or federal courts located in Napa County, California, and each party consents to the jurisdiction of those courts.
14. General
These terms, together with the Privacy Policy, are the entire agreement between you and us concerning this site. If any provision is found unenforceable, the rest remain in effect, and our failure to enforce a provision is not a waiver of our right to enforce it later. You may not assign your rights under these terms; we may assign them as part of a merger, acquisition, or sale of all or part of our business.
